Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the FamilyCart mobile application (the "Service") operated by FamilyCart ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Free tier data is stored locally on your device only and is not synchronized across devices or shared with other users.
FamilyCart Premium is a paid subscription service that provides additional features:
Premium subscriptions are available on a monthly or annual basis. You will be billed in advance on a recurring basis according to your chosen subscription plan.
Important: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Subscriptions are billed through Google Play Store. All billing is handled by Google, and you agree to Google Play's terms of service regarding payments and subscriptions.
You may cancel your subscription at any time through your Google Play Store account settings. Upon cancellation:
All purchases are handled by Google Play Store. Refund requests must be made through Google Play according to their refund policy. We do not directly process refunds.
Our Service allows you to create, store, and share grocery lists and related content ("User Content"). You retain all rights to your User Content.
By using our Service, you grant us the right to store, process, and transmit your User Content solely for the purpose of providing the Service to you.
You are responsible for your User Content and warrant that:
Premium users may share their grocery lists with other users through the household sharing feature. When you share a list:
You should only share lists with people you trust. We are not responsible for actions taken by household members you invite.

The Service and its original content (excluding User Content), features and functionality are and will remain the exclusive property of FamilyCart and its licensors.
Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination:
You may delete your account at any time through the app settings.
In no event shall FamilyCart, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied.
We do not warrant that:
While Premium users benefit from cloud backup, you are responsible for maintaining your own backups of important data. We are not responsible for any loss of data.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
These Terms shall be governed and construed in accordance with the laws of Florida, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
